TAKE NOTICE That the Board of Supervisors of Chesterfield County, Va., at an adjourned meeting on September 26, 2007 at 6:30 p.m. in the County Public Meeting Room at the Chesterfield Administration Building, Route 10 and Lori Road, Chesterfield, Va., will hold a public hearing where persons may appear and present their views concerning:

An Ordinance to amend the Code of the County of Chesterfield, 1997, as amended, by amending and re-enacting Section 19-227 of the Zoning Ordinance related to the sale of alcoholic beverages near schools, residentially zoned property, day care centers, churches and other places of worship.

The proposed amendment would require conditional use permit approval for commercial establishments seeking to sell alcoholic beverages, as defined in the Code of Virginia, § 4.1-100, for on-premises consumption, within 500 linear feet of a school, residentially zoned property, day care center, church or other place of worship. The proposed amendment would not require a conditional use for establishments that already possess a valid alcohol beverage license from the Virginia Department of Alcoholic Beverage Control so long as such license remains in force, is reissued as provided by law or, if such establishment is sold to a new owner, a valid license is issued to the new owner and such license remains in force or is reissued as provided by law. After the public hearing, appropriate changes or corrections may be made to the ordinance.

NOTICE OF ORDINANCE ESTABLISHING A SPECIAL ASSESSMENT FOR THE LOWER MAGNOLIA GREEN COMMUNITY DEVELOPMENT AUTHORITY AND APPROVING A SPECIAL ASSESSMENT AGREEMENT WITH THE LOWER MAGNOLIA GREEN COMMUNITY DEVELOPMENT AUTHORITY AND MAGNOLIA GREEN DEVELOPMENT LLC REGARDING THE FINANCING OF CERTAIN INFRASTRUCTURE

Notice is hereby given of the intention of the Board of Supervisors of Chesterfield County, Virginia (the "Board") to consider at its meeting to be held on September 26, 2007, an ordinance entitled "ORDINANCE ESTABLISHING A SPECIAL ASSESSMENT FOR THE LOWER MAGNOLIA GREEN COMMUNITY DEVELOPMENT AUTHORITY AND AUTHORIZING A SPECIAL ASSESSMENT AGREEMENT WITH THE LOWER MAGNOLIA GREEN COMMUNITY DEVELOPMENT AUTHORITY AND MAGNOLIA GREEN DEVELOPMENT LLC REGARDING THE FINANCING OF CERTAIN INFRASTRUCTURE." The proposed ordinance will establish a special assessment (the "Assessment") to secure bonds to be issued by the Lower Magnolia Green Community Development Authority (the "Authority") in the maximum principal amount of $35,000,000. The Assessment will be distributed among real estate within the Lower Magnolia Green Community Development Authority District (the "District"). The purpose of the Assessment is to finance certain transportation infrastructure improvements benefiting property within the District. The District, which was created by ordinance enacted on August 22, 2007, consists of the following tax map parcels: 703-667-2227; 703-667-2274; 698-669-6309. The parcel numbers given are the parcel numbers as of August 22, 2007. The assessment will be distributed among the property owners pursuant to a rate and method prepared by MuniCap, Inc. The proposed ordinance also authorizes the County to enter into a Special Assessment Agreement with the Authority and Magnolia Green Development LLC, the owners of land in the District, which approves the assessment and the issuance of the Authority's bonds to finance certain road improvements. A copy of the full text of said Ordinance, of the Special Assessment Agreement, and of the apportionment of assessment, is on file in the office of the County Administrator located at 9901 Lori Road, Chesterfield, Virginia, where it may be viewed during regular business hours. Case 74S021 required 940 acres of open space; this amendment would reduce the total to 912.9 acres. Open space would consist of 473.3 acres owned by Brandermill Comm.
