PUBLIC NOTICE

Take notice that the Board of Supervisors of Chesterfield County, Virginia, at a regular scheduled meeting on January 23, 2008 at 6:30 p.m. in the County Public Meeting Room at the Chesterfield Administration Building, Rt. 10 and Lori Road, Chesterfield, Virginia, will hold a public hearing where persons affected may appear and present their views to consider:

An Ordinance to amend the Code of the County of Chesterfield, 1997, as amended, by amending and reenacting Sections 19- 125, 19-227 and 19-301 of the Zoning Ordinance relating to regulation of farm wineries. In accordance with mandates of state law, the proposed amendments would (1) allow on Agriculturally zoned land the sale of wine-related items that are incidental to the sale of wine at a farm winery licensed under state law; (2) exempt the sale or consumption of wine at a licensed farm winery from the County Code requirement to obtain a conditional use permit for commercial facilities seeking to sell alcoholic beverages for on-premises consumption within 500 linear feet of certain schools; and (3) include licensed farm wineries within the definition of "farm" in the County's zoning ordinance.

A copy of the full text of the ordinance is on file in the Office of the Clerk to the Board of Supervisors and the County Administrator's Office, Room 504, 9901 Lori Road, Chesterfield County, Virginia and may be examined by all interested persons between the hours of 8:30 a.m. to 5:00 p.m., Monday through Friday. The hearing is held at a public facility designed to be accessible to persons with disabilities. ORDER OF PUBLICATION

The object of the above-styled proceeding is to acquire, by condemnation, certain land situated in Chesterfield County, Virginia for the purpose of a public road together with all necessary facilities relating thereto, and to apply for the empanelment of jurors or application to the Court to ascertain just compensation for the land, said land and interests being more particularly described in a petition filed in this Court on the 25 day of September, 2007. And it appearing by affidavit filed according to law that the following owners are or may not be residents of the Commonwealth of Virginia, or their names and addresses are not known and that diligence has been used by and on behalf of the petitioner to ascertain such names and addresses without effect: Edward I. Wallerstein and Central Fidelity Bank, N.A., Executors and Trustees under the will of Emanuel U. Wallerstein, deceased, Edward I. Wallerstein, Elsa W. Gerst, Ann W. Silverstein, and the heirs at law, devisees, assigns or successors in title of and to Edward I. Wallerstein and Central Fidelity Bank,N.A., Executors and Trustees under the will of Emanuel U. Wallerstein, deceased, Edward I. Wallerstein, Elsa W. Gerst, Ann W. Silverstein, and any and all persons unknown to petitioner who may own an interest in, or claim an interest in,the land described in the Petition filed in this proceeding all of whom are collectively identified as "UnknownOwners." Therefore, it is ORDERED that the aforesaid owners appear within ten (10) days after due publication of this order in the Clerk's Office of the Circuit Court of Chesterfield County, Virginia and do what is necessary to protect their interests. It is further ORDERED that if the above named owners desire to assert any objection or defense to the taking of the property or to the jurisdiction of the Court to hear the case and to proceed with the appointment of commissioners, they shall file their answer and grounds of defense designating the property in which they claim to be interested, the grounds of any objection or defense to the taking of their property or the jurisdiction of the Court to hear the case and to proceed with the empanelment of jurors or application to the Court to ascertain just compensation.

Should such owners fail to file their answer and grounds of defense as here in above provided, such failure shall not preclude them from appearing on the date set for the empanelment of jurors or application to the Court for determining just compensation nor from presenting evidence as to valuation and damage nor from sharing in the award of just compensation according to their interest therein or otherwise protecting their rights, but such failure shall preclude such owners from any other defense by way of pleas in bar, abatement or otherwise.

AND IT IS FURTHER ORDERED that the foregoing portion of this Order be published once a week for two consecutive weeks in "The Chesterfield Observer."

AND IT IS FURTHER ORDERED that a copy of this Order be posted at the front door of the Courthouse of the Circuit Court of Chesterfield County, Virginia within ten (10) days after entry of this Order. Enter: 11/19/07

PUBLIC NOTICE In accordance with Section 403.8(F)(2)(vii) of the Federal Pretreatment Regulations, the Public is hereby notified that in the year 2007, the following industries have discharged industrial wastewater into the Chesterfield County publicly owned treatment works in Significant Non- Compliance (SNC) with the applicable pretreatment standards and requirements:

Alstom Power, Inc. was in SNC during the six month period of April 1, 2007 thru September 30, 2007 for failing to meet discharge permit limits for mercury. Alstom Power, Inc. is no longer in SNC with the applicable Federal and Local pretreatment regulations as of year-end 2007.

2. Hill Phoenix, Inc.

Colonial Heights, VA 23834-5937

Hill Phoenix, Inc. was in SNC from April 1, 2007 to September 30, 2007 for failing to meet daily and monthly average discharge permit limits for zinc. Hill Phoenix, Inc. is no longer in SNC with the applicable Federal and Local pretreatment regulations as of year-end 2007.

The object of this suit is to obtain an Order for removal of remains buried in an abandoned graveyard in the Matoaca District of Chesterfield County, Virginia, pursuant to the provisions of Section 57- 38.1 of the Code of Virginia (1950), as amended, on a parcel of land owned by Douglas R. Sowers and Susan S. Sowers, acquired by deed dated June 28, 2002, recorded July 12, 2002, in the office of the Clerk of the Circuit Court of Chesterfield County, Virginia in Deed Book 4601, Page 120, corrected by Deed of Correction recorded July 18, 2002 in Deed Book 4607, page 690, and to re-inter such remains with due care and decency in another, more suitable repository acceptable to this Court. It is alleged in the Complaint filed in this Court that there are or may be persons whose names are unknown and who may be interested in the subject matter of this suit who may have ancestors or relatives located in such abandoned graveyard who are made parties defendant by the general description "Parties Unknown". It is hereby ORDERED, that each of said parties made defendants by the general description of "Parties Unknown" do appear on or before February 27, 2008, at 8:55 a.m. and do whatever is necessary to protect his or her interests.
