Take notice that the Board of Supervisors of Chesterfield County, Virginia, at an adjourned meeting on Wednesday, June 24, 2009 at 6:30 p.m. in the County Public Meeting Room at the Chesterfield Administration Building, Route 10 and Lori Road, Chesterfield, Virginia, will hold a public hearing where persons may appear and present their views concerning:

An Ordinance to amend the Code of the County of Chesterfield, 1997, as amended, by amending and re-enacting Section 19- 25 of the zoning ordinance relating to planning fees. The legal authority for enactment of these fees, levies, increases and/or reductions includes the County Charter and Va. Code § 15.2-2286(A)(6). Except as described below, no other new, increased or reduced fees are proposed with this amendment.

In addition to any other fees required by the County under other ordinances, the amendment would change application fees for certain conditional use applications. The zoning ordinance now includes a conditional use fee category titled "all others" that provides for fees of $5,300 plus $90 per acre for certain residential uses and $4,100 plus $80 per acre for certain office, commercial and industrial uses. The proposed amendment would: (1) separate out from the "all others" category a new category of conditional uses for communication towers, landfills, quarries, mines, borrow pits and adult businesses for which the fees would be $5,300 for residential uses plus $90 per acre after the first acre and $4,100 for office, commercial and industrial uses plus $80 per acre after the first acre and (2) reduce fees for the remaining "all other" category to $2,200 plus $90 per acre after the first acre for residential uses and $1,130 plus $80 per acre after the first acre for offi ce, commercial and industrial uses.

The proposed ordinance amendment and information concerning the documentation for the proposed fee, levy, increase and/or reduction are available for examination by the public in the County Administrator's Office (Room 505) at the Lane B. Ramsey Administration Building, 9901 Lori Road, Chesterfield, Virginia and at the Chesterfield County Planning Department, at the Chesterfield County Community Development Building, 9800 Government Center Parkway, Chesterfield, Va. NOTICE Take notice that the Board of Supervisors of Chesterfield County, Virginia, at an adjourned meeting on June 24, 2009, at 6:30 p.m. in the County Public Meeting Room at the Chesterfield Administration Building, Rt. 10 and Lori Road, Chesterfield, Virginia, will jointly hold a public hearing with the Virginia Department of Transportation where persons affected may appear and present their views to consider:

Updating the 2010 Fiscal Year Secondary Road Improvement Budget. Interested citizens may present comments regarding the budget. The budget is available at the Chesterfield County Transportation Department located in the Chesterfield County Community Development building at 9800 Government Center Parkway, 3rd Floor, or call 748-1037, between the hours of 8:30 a.m. to 5:00 p.m.

••• An Ord to amend the Code of the Co of Chesterfield 1997 as amended by amending Sections 8-1 & 8-2 of the Erosion & Sediment Control Ord & Section 19-238 of the Zon Ord. Specifically the amdts would prohibit "mass grading" within the Upper Swift Creek Watershed & would define "mass grading" as the process of altering existing ground contours of more than 80% of the area of any single residential lot as shown on approved construction plans but would not include alteration of lots (i) that are less than 10000 square feet (ii) that are more than 10000 square feet after issuance of a certificate of occupancy for a primary residence on the property or (iii) as otherwise approved by the director of environmental engineering when necessary for storm water management purposes. The director's decision to deny a request for an exception to the mass grading prohibition for storm water management purposes may be appealed to the Circuit Court.

After the public hearing appropriate changes or corrections may be made to the proposed amdts. Questions should be directed to Dick McElfish Director of Environmental Engineering at 748-1038.

••• An Ord to amend the Code of the Co of Chesterfield 1997 as amended by amending & re-enacting sections 19-510 & 19- 513 rel to off -street parking for businesses incidental to a dwelling. The current Ord requires these businesses to comply with parking standards as though the property were located in an O C or I District. The proposed amdt would exempt these uses from the parking requirements of the Zon Ord except the requirement to provide suffi cient off -street parking & allow staff to address specific requirements for parking through the Conditional Use process.

••• An Ord to amend the Code of the Co of Chesterfield 1997 as amended by amending & re-enacting Sections 17-1 17-32 17- 38 & 17-63 of the Subdivision Ord & 19-1 19-55 19-56 19-58 & 19-59 of the Zon Ord rel to dam break inundation zones. The proposed amdt would include safety from failure of impounding structures & impacts within dam break inundation zons in the Subdivision & Zon Ords purpose statements; require the Co to review potential impacts of mapped dam break inundation zons through the tentative subdivision process; require applicants to depict the location of mapped dam break inundation zons on tentative plat applications; prohibit land subdivision within a mapped dam break inundation zon unless the division complies with state law; expand the purpose of floodplain dist provisions to include dam break inundation zones; require the director of environmental engineering to maintain copies of all mapped dam break inundation zons; prohibit residential structures within a dam break inundation zone unless the director of environmental engineering finds that the structure will not represent a significant risk to life or safety; & include risk of dam break inundation as a consideration for floodplain district variances & development standards modifications.
