uuu An ord to amend the Code of the Co of Chesterfield, 1997, as amended, by amending & re-enacting Section 17-44 of the Subdivision Ordinance relating to parcel subdivisions that are not intended for residential use. The amendment would require statement on the parcel plat which: (i) identifies the zoning of the parcel, (ii) for Agricultural and Residentially zoned parcels, certifies through signature of the parcel owner & the Co that the creation of the parcel is not for residential use, (iii) clarifies that no parcel modified by this plat process may be used for residential purposes until the parcel is approved through subsequent subdivision process in accordance with the requirements of the Subdivision Ordinance.

uuu An ord to amend the Code of the Co of Chesterfield, 1997, as amended, by amending & re-enacting section 19- 555 & adding section 19-555.1 of the zoning ordinance relating to accessory building sizes & setbacks in Residential (R) & certain Manufactured Home (MH) zoning districts. In R and MH dists, the amdt would: (1) increase the current minimum rear & side yard setbacks for accessory buildings of 1,000 gross square feet or greater to match the setbacks for the principal dwelling on the lot or parcel & (2) require such accessory buildings to meet the front & corner side yard setbacks for accessory buildings as outlined in secs 19-555(1) & 19-555(3). Public Notice – Environmental Permit

PURPOSE OF NOTICE: To seek public comment on the draft permit from the Department of Environmental Quality that will allow the filling of wetlands and stream bed in Chesterfield County, Virginia. PUBLIC COMMENT PERIOD: For 30 days starting from the day after the notice is in the newspaper. October 7, 2010 to 5 p.m. on November 5, 2010. PERMIT NAME: Virginia Water Protection Program (VWPP) Permit 09-0471 issued by the Department of Environmental Quality under the authority of the State Water Control Board. NAME, ADDRESS, AND PERMIT NUMBER OF APPLICANT: Chesterfield County, Attn: Richard McElfish, 6806 West Krause Road, Chesterfield, VA 23832. Permit Number: VWPP Individual Permit No. 09-0471 PROJECT DESCRIPTION: Chesterfield County Department of Environmental Engineering is requesting a Virginia Water Protection Individual Permit to authorize the filling of wetlands and stream bed in order to construct a regional stormwater management facility known as Little Tomahawk Creek 20/25 (LTC-20/25). The proposed LTC-20/25 project will be located adjacent to the Armistead at Charter Colony subdivision. The proposed project will result in the permanent impact to 0.09 acres of forested wetlands and 988 linear feet of stream bed associated with an unnamed tributary of Little Tomahawk Creek located in the James River watershed. A watershed is the land area drained by a river and its incoming streams. The applicant is also requesting this VWP Individual Permit authorize offsite stream restoration to compensate for stream impacts incurred at the LTC-20/25 site. Permanent impacts to forested wetlands will be compensated through the purchase of 0.18 acre of wetland mitigation credits from the Weatherbury Mitigation Bank located in Chesterfield County, Virginia. Permanent impacts to stream bed will be compensated through the restoration and enhancement of not less than 1,115 linear feet of an unnamed tributary to Falling Creek flowing through the Mid-Lothian Mines Park located on North Woolridge Road. This stream segment is also within the James River watershed. The restoration project will use natural stream design and will result in permanent impacts to 46 linear feet of stream bed. These impacts will be considered self mitigating and as such will not require compensatory mitigation. DEQ’s preliminary decision is to approve the permit. HOW TO COMMENT AND/OR REQUEST A PUBLIC HEARING: DEQ accepts comments and requests for public hearing by e-mail, fax or postal mail. All comments and requests must be in writing and be received by DEQ during comment period. Submittals must include the names, mailing address and telephone numbers of the commenter/ requester and of all persons represented by the commenter/requester. A request for public hearing must also include: 1) The reason why a public hearing is requested. 2) A brief informal statement regarding the nature and extent of the interest of the requester or of those represented by the requester, including how and to what extent such interest would be directly and adversely affected by the permit. 3) Specific references, where possible, to terms and conditions of the permit with suggested revisions. DEQ may hold a public hearing, including another comment period, if public response is significant and there are substantial disputed issues relevant to the permit.
