PUBLIC NOTICE The Planning Commission of Chesterfield County on Tuesday July 19 2011 beginning at 6:00 pm in Public Meeting Room at 10001 Iron Bridge Rd Chesterfield Virginia will consider following requests. An Ord to amend Code of the County of Chesterfield, 1997, as amended, by amending & re-enacting Sec 19-518 of Zoning Ordinance relating to landscape maintenance bonds. Where cost of landscaping is more than $1,000, the amendment would allow, at developer’s option, (i) posting of surety in amount of 50% of landscaping cost or (ii) submission of a guarantee, which would run with the land, from landscape contractor and property owner that any landscaping which dies, is dying, becomes diseased or pollarded within the 1st year of planting will be replaced. It would also (i) delete language allowing temporary certificate of occupancy (CO) prior to landscape completion, (ii) allow director of planning to permit phasing of landscape installation for all projects, not just “larger development projects”, (iii) when surety is submitted, require landscaping to be installed by 1st planting season following issuance of surety, instead of date of issuance of temporary CO, (iv) delete language duplicative of other sections of zoning ordinance, and (v) reformat and clarify other language. An Ord to amend Code of the Co of Chesterfield, 1997, as amended, by amending & re-enacting Sec 19-25, 19- 241 and 19-521 of Zoning Ord relating to development standards for buffers & screening and fees for appeal. Current zoning ord prohibits locating retention or detention basins in required buffer unless exception is obtained from Planning Commission or Board of Supervisors. Proposed amendment deletes prohibition but allows administrative approval through plan review process of an encroachment of storm water or best management practice facilities (SWM/BMP) into required buffer if screening, topography or other measures effectively accomplish intent of buffer. Although current fees for an appeal by person aggrieved by decision of the planning director relating to plan review are $400 for residential uses and $350 for office, commercial and industrial uses, the proposed amendment would allow a person aggrieved by encroachment of SWM/BMP into a required buffer to appeal to Planning Commission without paying appeal fee. After a public hearing, the Planning Commission may recommend changes in the proposed amendment. Fee recommendations could range from (i) no change in current fee schedule to (ii) no fee for appeal of this specific buffer decision and (iii) any combination in between. Legal authority for enactment of fees, levies, increases and/or reductions includes the Chesterfield Co Charter and Va. Code § 15.2-2286(A)(6). Except as described herein, no other new, increased or reduced fees are proposed with amendment.
