Take notice that the Board of Supervisors of Chesterfield County, Virginia, at an adjourned meeting on Wednesday, March 20, 2013 at 6:30 p.m. in the County Public Meeting Room at the Chesterfield Administration Building, Route 10 and Lori Road, Chesterfield, Virginia, will hold a public hearing to consider: An ordinance to amend the Code of the County of Chesterfield, 1997, as amended, by amending and re-enacting Section 18-27 relating to utility charges. This ordinance is being proposed pursuant to authority granted to the County by Va. Code §§ 15.2-2109, 15.2-2118, 15.2-2119 and 15.2-2143. The full text of the ordinance is reproduced below. A copy of the ordinance is also on file in the County Administrator’s office, Room 304, 9901 Lori Road, Chesterfield County, Virginia and may be examined by all interested persons between the hours of 8:30 a.m. and 5:00 p.m., Monday through Friday. The hearing is held at a public facility designed to be accessible to persons with disabilities. AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND RE-ENACTING SECTION 18-27 RELATING TO UTILITY CHARGES BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Section 18-27 of the Code of the County of Chesterfield, 1997, as amended, are amended and re-enacted to read as follows: Sec. 18-27. - Utility charges. Effective with bills issued on and after July 1, 2012 2013, the consumer shall pay charges for utility service in accordance with the following schedules: (a) Monthly service charges. The monthly service charge shall be: (1) Customer cost charge. A customer cost charge of $2.44 for each service account. However, customers who have only a water account or a wastewater account shall pay a customer cost charge of $4.88. (2) Commodity cost charge. (i) Water: $1.42 $1.47 per 100 cubic feet (Ccf). (ii) Wastewater: $1.62 $1.78 per 100 cubic feet (Ccf). (3) Capacity cost charge.

In addition to restructuring regulations from text to chart format, the proposed amendments would: (i) require violations of the banner regulations to be corrected within 24 hours rather than ten days and allow denial of a banner application for up to one year if the applicant has received two notices of violation within any 12 month period; (ii) redefine “banners” to delete the requirement that banners only advertise a special promotion or activity; (iii) expand the permissible uses of banners; (iv) streamline the application process; (v) allow businesses to display banners for 120 days per year instead of 60 days; (vi) allow banners to be displayed for up to 60 consecutive days instead of 30 consecutive days; (vii) reduce the permissible size of freestanding banners from 50 sq. feet to 32 sq. feet; (viii) allow building mounted banners to be up to 15% of the building face; and (ix) modify the permitted locations, number and size of certain permitted banners. • • • * These cases were deferred at a previous session by Planning Commission to their March 19 2013 public hearing. ELDERLY AND DISABLED BE IT ORDAINED by the Board Supervisors of Chesterfield County: That Section 9-25 of the Code of the County of Chesterfield, 1997, as amended, are amended and re-enacted to read as follows: Sec. 9-25. Schedule of exemptions permitted. (a) The amount of exemption from real estate taxation under this section shall be determined in accordance with the following schedule: Income Percentage Categories of Exemption (i).$0.00 through $37,000.00 27,200.00 100 (ii)$37,001.00 27,201.00 through $48,500.00 39,000.00 60 (iii)$48,501.00 39,001.00 through $52,000.00 35 (b) The tax exemption provided by section 9-24 shall not exceed $2,000.00 for income categories a(ii) and a(iii) above. (2) That this ordinance shall become effective immediately upon adoption.
