NOTICE OF SUBSTITUTE
TRUSTEE’S SALE

WHEREAS, default having been made in the payment of the debts and obligations secured by that certain Deed of Trust dated October 30, 2008, by Martha Ann Stewart to James H. Hudson, III, Trustee, for the benefit of Mortgage Electronic Registration Systems, Inc., as nominee for C&F Mortgage Corporation, as same appears of record in the Circuit Court of the County of Chesterfield, Virginia, in Book 8501, Page 846, (“Deed of Trust”); and WHEREAS, said Deed of Trust was last sold, assigned and transferred to Bank of America, N.A., the current holder of the Note (Note Holder); and WHEREAS, the Note Holder appointed the undersigned, Thomas E. Clements, a resident of Henrico County, Virginia, as Substitute Trustee by Substitution of Trustee as same appears of record in the Circuit Court of the County of Chesterfield, Virginia, in Book 11410, and, Page 56. NOW THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Noteholder, and that the undersigned, Thomas E. Clements, Substitute Trustee, or his duly appointed attorneys or agents, by virtue of the power and authority vested in him, will on November 10, 2016, at 1:00 p.m., at the Chesterfield Courthouse, located at 9500 Courthouse Rd, Chesterfield, VA 23832, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in County of Chesterfield, Virginia, to wit: ALL that certain lot, piece or parcel of land with all improvements thereon and appurtenances thereunto belonging, lying and being in Clover Hill District, Chesterfield County, Virginia, and being more particularly bounded and described in accordance with plat of survey made by George M. Stephens Jr., Certified Land Surveyor, dated November 20, 1978, entitled “Plat of No.1321 Coalfield Road., Chesterfield Co., Va.”, as follows: BEGINNING at a point on the eastern line of Coalfield Road marked by an old pipe; said point being distant thereon 1464 feet, more or less, in a southerly direction from the centerline of Lucks Lane; thence N. 66 36 20” E. 290.40 feet to an old pipe; thence S 23 23 40” E. 150 feet to an old pipe; thence S. 66 36 20” W. 290.40 feet to an old pipe in the eastern line of Coalfield Road; thence with Coalfield Road and fronting thereon N. 23 23 40” W. 150 feet to the point and place of beginning. BEING the same real estate conveyed to Martha Ann Stewart from John E. Johnson and Fred J. Bernhardt, Jr., Executors of and Trustees under the Will of James G. McCann, Jr., deceased, dated October 21, 2008 and recorded simultaneous in the Clerk’s Office, Circuit Court, Chesterfield County, Virginia on October 31, 2008 in Book 8501, Page 841 .

TERMS: Cash. A bidder’s deposit of up to ten percent (10%) of the bid amount may be required in cash or certified funds at the time of the sale.
