By virtue of the power and authority contained in a Deed of Trust dated November 28, 2005, and recorded in Deed Book 6812, Page 601 in the Clerk’s Office for the Circuit Court for Chesterfield County, VA, securing a loan which was originally $359,600.00. The appointed SUBSTITUTE TRUSTEE, Commonwealth Trustees, LLC will offer for sale at public auction at the front steps of the Circuit Court for Chesterfield County located at 9500 Courthouse Road on: July 24, 2017 at 10:30 AM improved real property, with an abbreviated legal description of Parcel I ALL that certain piece or parcel of land with improvements thereon and appurtenances thereunto belonging, lying and being in Manchester District, Chesterfield County, Virginia, containing five (5) acres, more or less, and bounded and described as follows:

BEGINNING at a rod on the western line of Belmont Road, corner with the land now or formerly of Robert L. Woolf; thence extending north 87 degrees 17’ 30” West 598.5 feet to a rod; thence extending north 8 degrees East 365.5 feet to a road; thence South 87 degrees 17’ 30” East 598.5 feet to a rod; thence South 8 degrees West 365.5 feet to the place of beginning. Parcel II ALL that certain parcel of land, lying and being in Manchester District, Chesterfield County, Virginia, containing 0.32 acres, more or less, described as follows: COMMENCING at a rod situated at the point of intersection of the southwardly corner of the land of Bernie C. Lear (as shown on the hereinafter mentioned plat) with the northwardly line of Belmont Road; thence along the said line of the said road South 54 degrees 06’ West 117 feet to a point; thence continuing along the said line of Belmont Road as it curves to the left in a southerly direction 214.8 feet to a point where the said road touches the land of John M. Goodwin; thence along easterly line of the land of the said Goodwin, North 9 degrees 00’ East 260.05 feet to a rod (which rod is distant 456.5 feet southwardly from a stone); thence South 86 degrees 17’ 30” East 154.06 feet to the point of beginning, the said property being more particularly shown on a plat thereof made by W. W. LaPrade and Bros., Civil Engineers, dated July 7, 1950, revised January 27, 1955. LESS AND EXCEPT all that certain parcel of land conveyed to the Commonwealth of Virginia by Deed from Joan M. Meiller, Widow, dated February 15, 1979 recorded June 5, 1979 in the Clerk’s Office, Circuit Court, Chesterfield County, Virginia, in Deed Book 1398, page 836, and as more fully described in the aforesaid Deed of Trust. TERMS OF SALE: The property will be sold “AS IS,” WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, restrictions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust to be announced at the time of sale. A deposit of $20,000.00, or 10% of the sale price, whichever is lower, in cash or cashier’s check payable to the SUBSTITUTE TRUSTEE will be required at the time of sale. The balance of the purchase price, with interest at the rate contained in the Deed of Trust Note from the date of sale to the date said funds are received in the office of the SUBSTITUTE TRUSTEE, will be due within fifteen (15) days of sale. In the event of default by the successful bidder, the entire deposit shall be forfeited and applied to the costs and expenses of sale and Substitute Trustee’s fee. All other public charges or assessments, including water/sewer charges, whether incurred prior to or after the sale, and all other costs incident to settlement to be paid by the purchaser. In the event taxes, any other public charges have been advanced, a credit will be due to the seller, to be adjusted from the date of sale at the time of settlement. Purchaser agrees to pay the seller’s attorneys at settlement, a fee of $445.00 for review of the settlement documents. Additional terms will be announced at the time of sale and the successful bidder will be required to execute and deliver to the Substitute Trustees a memorandum or contract of the sale at the conclusion of bidding.

The object of the above captioned suit is to forfeit to the Commonwealth the described property or currency pursuant to Va. Code § 19.2-386.1 et. seq.

It appearing by affidavit filed according to law that (i) Clare Berry, whose last known whereabouts were in Long Beach, California, (ii) Shawnette Simone Saddler, whose last known whereabouts were in Lauderhill, Florida, (iii) Eric Weinstein, whose last known whereabouts were in Berkeley, California, (iv) Rita Kovas, whose last known whereabouts were in Berkeley, California, and (v) Zaira Vanessa Zelaya, whose last known whereabouts were in San Pablo, California, are non- Virginia resident individuals and it also appearing that the Commonwealth without effect used due diligence to ascertain the location of the remaining above-referenced Defendants in order to effect service of process, it is therefore ORDERED that ALL Defendants appear on or before August 25, 2017 at 9:00 a.m. in the Circuit Court of the County of Chesterfield, 9500 Courthouse Road, Chesterfield, Virginia 23832, and do what is necessary to protect their interests.

It is further ORDERED that this order be published once a week for four successive weeks in the Chesterfield Observer, printed and circulated in Chesterfield County, Virginia, and that a certificate of this of this publications is filed with the Circuit Court Clerk’s office prior to August 25, 2017 at 9:00 a.m.

It is further ORDERED that the clerk mail a certified copy of this order to the defendants listed above at the addresses provided by affidavit filed, and that a certified copy be sent to the Commonwealth’s Attorney.
