By virtue of the power and authority contained in a Deed of Trust dated March 16, 2009, and recorded in Deed Book 8637, Page 0125 in the Clerk’s Office for the Circuit Court for Chesterfield County, VA, securing a loan which was originally $184,500.00. The appointed SUBSTITUTE TRUSTEE, Commonwealth Trustees, LLC will offer for sale at public auction at the front steps of the Circuit Court for Chesterfield County located at 9500 Courthouse Road on: February 12, 2018 at 10:30 AM improved real property, with an abbreviated legal description of All that certain lot, piece or a parcel of land with all the improvements thereon and appurtenances thereunto belonging, lying, being and situated in Chesterfield County, Virginia, and known, numbered and designated as Lot 2, Block E, on the Plat of “River Road Estates” made by Brenner-Youngblood-Shape, Inc., C.E., dated October 10, 1972, recorded February 5, 1973, Clerk’s Office, Circuit Court, Chesterfield County, Virginia, in Plat Book 20, at page 14, and as more fully described in the aforesaid Deed of Trust. TERMS OF SALE: The property will be sold “AS IS,” WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, restrictions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust to be announced at the time of sale. A deposit of $20,000.00, or 10% of the sale price, whichever is lower, in cash or cashier’s check payable to the SUBSTITUTE TRUSTEE will be required at the time of sale. The balance of the purchase price, with interest at the rate contained in the Deed of Trust Note from the date of sale to the date said funds are received in the office of the SUBSTITUTE TRUSTEE, will be due within fifteen (15) days of sale. In the event of default by the successful bidder, the entire deposit shall be forfeited and applied to the costs and expenses of sale and Substitute Trustee’s fee. All other public charges or assessments, including water/sewer charges, whether incurred prior to or after the sale, and all other costs incident to settlement to be paid by the purchaser. In the event taxes, any other public charges have been advanced, a credit will be due to the seller, to be adjusted from the date of sale at the time of settlement. Purchaser agrees to pay the seller’s attorneys at settlement, a fee of $445.00 for review of the settlement documents. Additional terms will be announced at the time of sale and the successful bidder will be required to execute and deliver to the Substitute Trustees a memorandum or contract of the sale at the conclusion of bidding.

ORDER OF PUBLICATION The object of this cause is to effect the removal of the remains of the individual, August J. Halbleib (hereinafter “Father Halbleib”), who is buried in an abandoned gravesite located on a parcel of land owned by Amberleigh, LLC, a Virginia limited liability company (hereinafter “Amberleigh”), the remains in question appear to be located in Chesterfield County, Virginia, on a parcel of land containing 9.163 acres, more or less, being a portion of Tax Map Parcel 751687688300000 (the “Amberleigh Property”), as shown on a plat by Balzer & Associates, Certified Land Surveyors, dated May 9, 2007, recorded in the Clerk’s Office, Circuit Court, Chesterfield County, Virginia in Plat Book 178, page 56, a copy of which plat is attached to the Complaint filed in this cause; and the gravesite appears to have been abandoned and neglected; the purpose of this cause is to reinter said remains with due care and decency and in another, more suitable repository acceptable to this Court, and it has been alleged in the Complaint filed herein that there are or may be persons whose names are unknown interested in the subject matter of this cause or who may be a descendant of Father Halbleib, who are made parties defendant hereto by the general description of ‘’Parties Unknown”; and under the circumstances being appropriate to do so, it is accordingly ORDERED that the defendants listed in the Complaint be made defendants herein by the general description of “Parties Unknown”, and that said parties do appear on or before February 2, 2018 at 8:30 o’clock a.m. in this Court and do whatever they deem necessary to protect their interests in this cause.

ORDER

The object of the above captioned suit is to forfeit to the Commonwealth the described property or currency pursuant to Va. Code § 19.2-386.1 et. seq.

It appearing by affidavit filed according to law that Wail Alsaidi, whose last known whereabouts were in Hazelton, Pennsylvania is a non- Virginia resident individual and it also appearing that the Commonwealth without effect used due diligence to ascertain the location of the remaining above-referenced Defendants in order to effect service of process, it is therefore ORDERED that ALL Defendants appear on or before April 13, 2018 at 9:00 a.m. in the Circuit Court of the County of Chesterfield, 9500 Courthouse Road, Chesterfield, Virginia 23832, and do what is necessary to protect their interests.

It is further ORDERED that the clerk mail a certified copy of this order to the defendants listed above at the addresses provided by affidavit filed, and that a certified copy be sent to the Commonwealth’s Attorney.
